Gender Inequality in the Construction Industry: The Future of Diversity

Gender-Equality

When it comes to sectors that could still see a lot of improvement in gender equality, construction has a lot to work on. Macdonald & Company found from their 2019 Rewards and Attitudes survey that the gender pay gap in the industry at 20%, which is higher than the UK average of 18%.

This is the only one of the many reasons women could be deterred from entering the industry, on top of other pre-existing issues. The survey from 2019 found that 72% of female construction workers had been subject to some form of gender discrimination.

Here, with some insights from van leasing company, Van Ninja, we’ll examine where these stereotypes originate from and their impact on the industry. We will also look to the future and whether we’ll ever see an actual 50/50 split in the workforce.

Back to school – the root of sexist mentalities towards construction?

External perceptions are important for roles across all levels and industries. If it isn’t attractive to candidates, they’re less likely to apply and provide a strong work ethic or creative approach. Construction suffers from archaic stereotypes that create a negative stigma of every worker in the industry as guarded, gatekeeping misogynists with every role requiring manual labour.

This could be a huge factor contributing to why from a young age, girls and women are taught that construction is not an attractive career to pursue. The stereotype that women aren’t strong enough to work in the industry comes from sexism and a lack of truth.

This results in a gender gap in school subjects that could help obtain a degree or a position within the sector. Data from JCQ showed that A-Level subjects useful for construction, such as computer sciences, design and technology, maths, and physics, are heavily skewed with an overwhelming number of male students across the board.

How is this impacting the industry?

In the grand scheme, around 12.5% of the construction industry workforce in the UK consists of women, with most roles in engineering, design, and administrative positions. This statistic accounting for England, Scotland, Wales, and Northern Ireland, is staggering, as the industry is one of the largest contributors to the UK economy, with 3.1 million people employed in it.

Diversity and inclusion (D&I) are crucial to industry progression. Women and men think differently, meaning their creative approaches will always differ and could significantly contribute both to businesses and innovation. While there is comfort in the familiar, creativity and productivity could cast the industry net wider.

The future of diversity in construction

Construction is an industry that will never be short of work with large-scale projects that require experienced hands and minds to create. As a result, could we see a future where the workforce is not only split more evenly between men and women, but one where non-binary, gender fluid, and others whose gender identity differs from the traditional understanding, may feel comfortable?

There is still plenty of work to be done to make this even split a reality. The Office for National Statistics found that between July and December 2020, only 10% of people employed in the construction industry were women. Even though we’ve seen an increase of 2.5% over almost two years, a 50/50 of men and women working in the industry could still be a minimum of two decades away if it keeps growing at a similar rate.

The Construction Skills Network (CSN) found in their statistics that the UK will need to fill 210,000 jobs in the industry, and these could be filled by women and young jobseekers. Making these roles and the wider sector more attractive to potential candidates from such a young age, onboarding and outreach programs could be the key to bridging the gap and bringing in new workers. This could be done through introductory days where different roles are broken down into their bare essentials, from procurement of materials through suppliers or fleet solutions with van leasing, to structuring the work and building a timeline for when the job will be completed.

Understanding VAT – Common Misconceptions Dispelled

Understanding VAT

If you are preparing for VAT registration, or just trying to figure out if you and your company even need to think about it then this article is for you.

We cover all critical VAT issues from who is eligible, to the registration process and what you need to prepare for registration.

This information is general so make sure you consult a registered taxation professional, as they will be able to advise you on the specifics of the situation.

1. How Much Do I Need To Earn To Pay VAT

There are different guidelines regarding the turnover threshold at which you are required to register and pay VAT.

If you are a member of the European Union the VAT taxable turnover threshold is £85,000. Once your taxable turnover exceeds this amount you must register for, and start managing VAT officially.

You are allowed to register for VAT voluntarily before reaching the taxable turnover threshold, but you are not required to. There can be some benefits to doing this as you can claim VAT deductions on certain expenses. But it does require a lot more paperwork.

If you are not located in the relevant area but still sell goods and services in the European Union and UK, then you will be required to register for and manage VAT regardless of the threshold.

Whether your taxable turnover is over £85,000 or under £85,000, it does not matter if you are operating from outside the EU, you will need to register and comply with VAT requirements.

2. Do You Need A VAT Number?

You only need a VAT number if your taxable turnover in 12 months exceeds £85,000. Under that figure, you are not required to register, but you can choose to register if you wish.

There is also a requirement for individuals and entities outside of the European Union to register for VAT, if they sell relevant goods or services in the EU, regardless of their taxable turnover.

However, when calculating your VAT taxable turnover some things do need to be included in the figures. Services that do not attract VAT include things like financial services, education, healthcare, sports, and charity events. Likewise, certain goods are VAT exempt including goods and items for hobbies, donations to charity, and goods bought from outside the European Union.

3. What Is VAT For Hotels?

Historically, VAT for the hospitality sector (including food, accommodation, and entertainment) was at 20%.

However, during July 2020 and the COVID-19 pandemic, this rate was reduced to just 5%. This was both to provide a source of financial relief for consumers and to try and stimulate more spending to support businesses.

This reduction could not last forever though, as it would mean a considerable reduction in taxation revenue for the government. This discount lasted until 30 September 2021 at which point it was raised, but not back to its previous level. It was raised to 12.5% as a way to continue supporting both consumers and businesses.

This subsequent discount was applied until Mach 2022 before traditional VAT rates of 20% were reinstated.

This Vat calculator worldwide can help you find the exact amount of VAT every time.

4. Is Parking VAT?

Parking your car can be done in various capacities and there are different VAT scenarios. In general, on-street parking is facilitated by the relevant local government, and thus no VAT is charged.

However, if you utilize off-street parking, then this would require dealing with a private individual or entity, and thus VAT is likely to be applied.

5. Should I Charge VAT On My Invoice?

The decision to charge VAT on your invoice is dependent on two things:

  • Whether you and your business are registered for VAT
  • Whether the goods or services are eligible for VAT

Whether You Are Registered For VAT

If you are not registered for VAT you are not allowed to charge and collect it on your invoices. Doing so without the required registration is a breach. You need to be registered for VAT if your VAT-taxable turnover is over £85,000 in 12 months. If you do not meet this threshold you can still volunteer to register for VAT, and subsequently charge for it on your invoice. If your VAT taxable turnover does cross this threshold then you do need to be VAT registered.

Are Your Goods Or Services Eligible for VAT

The other key factor that will influence whether you need to put VAT on your invoice is whether the goods or services you are selling are VAT exempt. Certain services, including financial services and health care services, are exempt from VAT, thus it would not be appropriate to add VAT to the invoice. Similarly, some goods, including goods from outside the EU and UK are not required to include VAT.

6. Can I Claim VAT Without A VAT Receipt

No.

If you wish to reclaim VAT on eligible purchases you or your business has made then you must have a VAT-compliant receipt. If you do not have a VAT-compliant receipt you cannot reclaim the VAT.

7. Is VAT Different From Customs Duty?

Yes, VAT and customs duty are two separate things. Customs duties are arbitrarily determined by each country and vary from item to item based on several different characteristics.

In many cases, you don’t need to pay VAT for items you have purchased from outside of the EU or UK.

For a lot of consumer goods, customs duties are between 5-7% of the import value.

While custom duty may vary, VAT does not change.

8. What Is VAT Deregistration?

VAT deregistration describes the process of removing your company from the HMRC register of VAT-eligible companies.

VAT deregistration should be considered in a variety of situations, including:

  • The registered person or entity is no longer trading in relevant goods and services
  • The value of VAT taxable turnover decreases below the threshold

If you have registered for VAT voluntarily, then you must wait for at least 12 months before commencing the VAT de-registration process.

9. Is VAT Going Digital?

Yes, the VAT process has now officially gone digital. As of April 2022 VAT registered businesses are required to prepare to lodge and manage their VAT affairs digitally.

10. Is There VAT On Flooring?

Yes, carpets and other floor coverings are eligible for VAT and charged at the standard rate.

11. Why Was VAT Introduced?

The VAT was implemented to resolve a range of problems associated with traditional sales taxation policies. It is one of the biggest revue drivers for the government, behind income tax

12. Does VAT Replace Income Tax?

VAT does not replace the income tax people pay, it is a different type of tax designed to increase government revenue without having to keep increasing income tax. It is a tax based on the value added to various goods and services across the whole economy, not just on the wages of workers.

13. What Documents Are Needed For VAT Registration?

Many different documents are required to register for VAT, depending on the nature of the entity that is registering.

If you are registering a company for VAT then you will need:

  • Incorporation Certificate
  • Names of People Involved In The Firm
  • Address proof of the Director
  • ID Proof of Director
  • Partnership Deed (if relevant)
  • All relevant contacts details

These documents listed are just a sample of what you will need to prepare in readiness for VAT registration. Ensure you consult a taxation professional with VAT expertise as you prepare for VAT registration.

What Does an Illustration Agency Do?

Illustration Agency

When you think of an illustration agency, you may have preconceived notions about what they do or how it can help your company.

However, speaking with an illustration agency is a new concept for most businesses and individuals. Many people have misconceptions about what such a service does or its importance.

Top children’s book illustration agencies such as Astound handles the pre-visualization of products, logos, and visuals for advertising or marketing. They are responsible for creating an image of the product being promoted. That said, the benefits of hiring an illustration agency are many. Here are just a few:

1. Brand Recognition and Trust

Your brand will be represented professionally, which instills confidence among your customers and helps them to trust your products more.

You may have heard that “the best way to get your message across is through visuals.” That is true, and it’s especially true when it comes to branding.

Your company may have a great product or service, but if it doesn’t have a solid visual identity, it will struggle to be easily recognized by consumers.

If you want your business to stand out from the crowd, an illustration agency can help you create a distinctive brand image that will help make your company memorable.

Better branding gives you a unique look that distinguishes your company from competitors. For instance, your logo and other marketing materials will reflect your company’s identity so that people know what they are getting when they choose to do business with you.

2. More Sales Opportunities

If you are looking for new customers, an illustration agency can help bring in more business by creating attractive marketing materials that include illustrations and other assets such as videos and photos.

A good illustration agency knows how to capture your brand’s personality and style, which can help you stand out in a crowded marketplace. The right image can create more sales opportunities for your business, especially if you have a unique product or service.

3. Better Customer Service Levels

An illustrator or artist will always have a portfolio of their work and be able to show you samples of previous projects when you’re considering whether they’re right for your business.

Illustrators have better customer service levels than other companies because they understand their clients’ needs. They know the language used by different groups and can deliver the right message to them, even if it is not in English.

As such, it makes them better at communicating with people who do not speak their native language. They can translate everything into a language you can understand easily, making your job easier.

If you have any questions or concerns about your project, an illustrator will respond quickly and efficiently so that you don’t have to find another way around it.

4. More Options for Payment Terms

Illustrators can get paid via a variety of payment terms. You must find an illustrator who can work with you on your budget and have them deliver on time.

If you have a tight budget, make sure they can help you with this and any other aspect of your project. The more options you have, the better off your project will be.

It is important to work with someone who can deliver on time but also be flexible enough to accommodate any changes in plan or schedule due to unforeseen circumstances.

You should also look for an illustrator who has experience working in the industry and knows what works best for different types of projects.

In Conclusion

When pursuing illustration as a career or hobby, it’s important to decide how best to get your work out there and make sure it sells. One of the best ways to do this is by joining an Illustration Agency with experience working with clients and getting your artwork into the market.

Create an Online Portfolio

Are you looking for a new method to showcase your work to potential employers?

A portfolio is a perfect way to do just that. Not only will it help you get hired fast, but also build a professional background that matches your skills.

In this article, we’ll provide some tips on how to make your portfolio stand out from the competition.

So let’s get started!

1. Do some research

Before creating an online portfolio, it is important to do your research. Decide what kind of portfolio you want to make. Do you want to showcase your work to potential employers? Or do you want to create a 3D portfolio that reflects your brand?

Either way, once you have a clear idea of your goals, you can begin to research the best platform for your needs. There are many different portfolio builders out there, so take some time to explore your options and get inspired.

In addition, think about how you want to present your work. Decide if you will include writing samples, photos, or videos. Choose the format that will match your skills and achievements.

2. Create a website

One of the easiest and most efficient ways to create an online portfolio is to use an AI website builder.

Website builders help you create a professional-looking website without prior experience or design skills. You can simply choose a template, add your work, and share your site with the world.

Best of all, many website builders are free or inexpensive, making it easy to start. We recommend using WordPress, as it is the top choice for freelancers and creators of different industries. You can now even use the WordPress tables plugin to ensure your customers book appointments anytime!

3. Choose your best projects

In any professional portfolio, it’s important to select projects that highlight your strengths and show off your unique perspective.

For example, if you’re a web designer, you might want to include a project that showcases your responsive design skills.

If you’re a photographer, you can include a series of black-and-white portraits that reflects your ability to capture emotion.

By carefully selecting your projects in your portfolio, you can give viewers a snapshot of your talent and expertise.

4. Choose high-quality images

Choosing high-quality images for your online portfolio cannot be underestimated. However, this tip is not only for photography services or design portfolios.

The proper image can make all the difference in conveying the professionalism and quality of your work to potential clients.

When choosing images for your portfolio, avoid using blurry or low-resolution photos. Instead, opt for clear, sharp images that accurately represent the type of work you do.

First impressions always count, so make sure that your work makes a positive one.

5. Update content

As a professional, keeping your online portfolio up-to-date with your latest work is essential.

Otherwise, potential clients or employers may get the wrong impression of your skills and experience.

Fortunately, it’s easy to make sure your portfolio is always current. Simply set aside some time each month to review it and add any new projects or pieces you want to publish.

You can also use this time to update your contact information and ensure links are still working correctly.

6. Work on your site’s SEO

If you want your online portfolio to be successful, it’s important to work on your site’s SEO. This means that your site should be properly optimized for search engines so that potential clients can easily find you.

There are several ways to improve your SEO, such as using keywords throughout your site, optimizing titles and descriptions, and creating authentic content.

Improving your SEO will ensure that the right target audience sees your portfolio.

7. Add Important Details

When creating a portfolio, it is necessary to include details that will give the reader a clear picture of your skills and experience.

Make sure you add your contact information, a brief biography, and a list of your work samples.

You can use the help of service scheduling software to manage multiple services at once.

If you have published articles or presentations, include those as well. Your portfolio should be tailored to the specific audience you are targeting.

For example, if you are seeking a position in web design, highlight your experience with HTML and CSS.

If you want to apply for a job in accounting, add your experience with financial software.

Including relevant details can give potential employers a better sense of your qualifications and increase your chances of landing the job you want.

8. Make your site mobile responsive

People use mobile devices a lot nowadays, and you should not miss the chance for potential employers to see your online portfolio.

You can easily make your portfolio look great on any screen size. First, choose a responsive theme for your website. This will ensure that your content scales and rearranges automatically to fit the width of any device.

Second, consider using a grid layout for your images and text. This will create a clean, organized look that is easy to navigate on a small screen.

Lastly, don’t forget to test your site on multiple devices before launch. This way, you can ensure everything works correctly and that anyone can see the website.

9. Ask for sincere feedback

Your portfolio must be in top shape before sending it out.

One way to do this is to ask for honest feedback from people whose opinions you trust. Show your portfolio to friends, family, and fellow artists, and ask them for their thoughts.

Pay attention to both positive and constructive criticism, and use it to improve your portfolio.

With a little effort, you can turn your online portfolio into your best professional investment.

10. Publish and promote your online portfolio

Once you have created your portfolio, there are many ways to promote it and ensure that potential clients see it.

One of the most efficient methods is to submit your portfolio to online directories. This will help to increase its visibility and make it easier for clients to find.

You can promote your portfolio through social media platforms such as Twitter and LinkedIn. By sharing links to your portfolio on these sites, you will be able to reach a wider audience and attract new clients.

You should also consider submitting it to review sites. This will allow potential clients to see what others have said about your work.

Conclusion

A well-done online portfolio is an essential part of any job search.

Following the tips we’ve outlined in this post, you can showcase your skills and experience in the best light possible.

Best Plagiarism Checker for Teachers: Meet the Best Tools

Plagiarism Checker

Educational establishments all over the globe consider plagiarism an academic crime. Being some sort of dishonesty, plagiarism is turning into a serious concern for not only educators but the rest of society as well. In order to combat plagiarism, teachers tend to develop various classroom management methods, as well as take special disciplinary actions in order to punish those who submit stolen works. One of the best ways to ensure this or that written piece is original is by using the best plagiarism checker tool. Up-to-date plagiarism tools for teachers help prove or question students’ honesty and, as a result, make the whole education process less hectic.

With plagiarism detection sites and apps, communication and collaboration between students and teachers get to a new level.

What Website Do Teachers Use To Check for Plagiarism?

When it comes to the best plagiarism website for teachers, the variety of options available on the web is impressive. If you wonder how can teachers check for plagiarism, you should know that the very moment they identify a suspicious piece of text, they use the following options to check its uniqueness:

  • First, they search in browsers. All you have to do is to copy and paste the part of the paper that you find suspicious and google it. You’re welcome to use any browser you prefer be it Bing, Internet Explorer, or Opera. Once the “search” button is hit, you will see the results that will either prove the fragment was stolen or demonstrate that the student is honest in his or her work.
  • Using an online plagiarism checker for teachers. All the apps and websites available on the web allow educators to check any paper for plagiarism as fast as possible.
  • Checking trusted sources. If you browse sources like Washington Post, the Guardian, CNN, or other reliable journals and magazines, you may find out the suspicious content was taken from there.

How Do Teachers Find Plagiarism?

In addition to the online plagiarism checker for teachers, every educator has a range of methods to detect plagiarism in students’ works. After all, they should always be on guard and review every assignment, regardless of its complexity level. There are several ways that can do that.

  • Inconsistency in writing. At some point, every teacher becomes familiar with the writing style of this or that student. For that reason, any sudden change in the prose may serve as proof the paper is not necessarily written by a particular student.
  • Different formats, fonts, and colors. In the digital era, students find it easy to copy huge segments of information and paste them into their academic works. But more often than not, they fail to cite these chunks of info properly. What is more, many of them forget to change the original font of the inserted piece. That’s when a teacher can identify the content that is plagiarized.
  • Tenses change chaotically. As a rule, academic works are created in the first plural person. That is why every sudden change in tenses or pronouns may indicate that ideas were stolen.

Finally, the best way to detect plagiarism is by using plagiarism checkers that can identify what piece of information has been plagiarized and where the original materials come from.

What Plagiarism Checker Teachers Use in University?

When it comes to colleges and universities, the requirements that are usually attached to the research papers, theses, term papers, capstone projects, or any other academic work are more complex while the deadlines are tougher. At the same time, students are extremely busy trying to juggle all the university tasks, part-time jobs, and extracurricular activities. As a result, a lot of them choose the use plagiarized content as the basis for their works. Taking into account the complexity level of university papers, the tools used to detect plagiarism must be trusted and deal with Ph.D. and Master’s level papers. The best plagiarism software for teachers like PlagiarismCheck.org is especially useful for educators that need to check the plagiarism level of students’ papers and provide detailed feedback. The service sticks to its promises to guarantee academic honesty and uphold integrity.

Plagiarism Check For Teachers: Why Is It Important?

One of the key reasons why using plagiarism detection software is important is because it enables teachers to help students boost their writing. Every online plagiarism checker for teachers detects plagiarized segments of work. As a result, students are required to edit their papers to improve the quality of writing. Not only will students learn to avoid plagiarism, but they will also enhance their abilities to cite and paraphrase the used sources appropriately.

At the same time, teachers can perform plagiarism checks in order to provide students with an opportunity to own responsibility for their documents. In other words, every time student is informed of the fact that his or her work includes plagiarized fragments, s/he will get to know more about what intellectual property rights are, as well as the consequences of stealing someone else’s written works without any acknowledgment. To cut the long story short, these apps and services are useful when it comes to cultivating ethical and moral principles in high school, college, and university students.

In high schools, colleges, and universities, plagiarism is one of the most serious issues at the moment. Moreover, in the case of essays, book reviews, and lab reports, plagiarism turns out to be unintentional sometimes. However, the good news is that there are many ways educators can scan students’ papers in order to see if they’re unique or not. Teachers have a great opportunity to benefit from online apps and websites to help students by teaching them simple ways to make sure every other assignment is original.

What are the services that the Steuerberatungskanzlei provides?

  1. Tax services for corporates – Taxation for businesses in Germany breaks down into two categories: corporate income taxes and individual entrepreneur and partnership income taxes. Businesses pay a local tax, the business profit tax, in addition to their regular income tax. Relocating a German company to a low-tax region can save the company a lot of money since it is a local tax. Value-added tax (VAT), a sales tax equivalent to the sales taxes in other countries like the United States, is applied to goods and services in Germany, with a few exceptions. Other business taxes include-
  2. Payroll services (e.g. payroll accounting, transmitting monthly wages-payment calculation, etc.) are examples of payroll accounting.
  3. Tax optimization of corporate and M&A transactions (acquisitions, restructuring, transformation, etc.), including tax due diligence.
  4. Tax office and German tax court litigation can be represented.
  5. International tax services – Difficulty with transfer pricing, withholding taxes, double taxation, international reporting requirements, permanent establishment taxation, IP boxes, controlled foreign companies provisions, and other international tax issues are frequently encountered by multinational firms. In addition to organising and optimising their assets for tax purposes, high-net-worth individuals must also do so. Individuals with large net worths are often invested in multinational firms, local companies, joint ventures, private foundations, and other financial vehicles spread across the world, as well as many bank accounts in different countries that hold a variety of currencies. A variety of currencies may be found in numerous bank accounts in different countries, which many of which keep a variety of currencies. Those with great wealth often have multiple homes and bases. This is why they may be taxed in more than one country. Double taxation, a reduced tax burden, and tax-efficient asset transfers to the next generation are just some of the difficulties posed by international tax issues when people and companies move across borders. In addition to addressing these concerns from a tax and political standpoint, high-net-worth individuals and businesses must do so from a tax-compliant standpoint because tax evasion has always been and will continue to be a foolish choice, particularly given the fact that national tax authorities cooperate internationally to prevent tax fraud.
  6. Tax services for M&A deals-  Sometimes, German firms become the target of acquisitions and mergers, frequently known as M&A. However, considering Germany’s not-quite-a-tax-haven status, buyers of target companies should always work with a tax lawyer to assess their tax risks and make sure that their professional help is sought. Although M&A decisions are typically motivated by strategic objectives, the target company’s tax risks are also vital for the buyer. Every tax and tax structure issue must be weighed before making a final decision on an M&A deal. Only after considering all tax and tax structure issues can an M&A process lead to profitable investments.
  7. Transfer Pricing Regulations – International businesses must be aware of German transfer pricing regulations. Transfer pricing includes establishing, evaluating, documenting, and altering charges between related parties in different countries (e.g. a parent company in country A and its subsidiary in country B) for goods, services, usage of (intangible) assets, and so forth. An adequate transfer price should equal what an independent consumer would be charged (the so-called arm’s-length principle). To avoid costly mistakes, it is critical to meticulous research the correct transfer prices. It is not enough to estimate them roughly. Typically, a comprehensive study is required and conducted with professional databases that analyze competitor transactions. The tax authorities typically use the same tools. In addition to determining the correct transfer prices, comprehensive documentation is required by law, specifying how and on what grounds the corporation determined the transfer prices. The significance of transfer pricing should not be underestimated. More than 50% of all transfer pricing disputes involve the tax authorities believing that prices are too low. The resulting tax burden is immense when transfer prices are corrected across one or more countries. To avoid this, observe the rules from the beginning. Comprehensive and accurate transfer pricing documentation is critical. A transfer pricing attorney can assist you with this. Transfer pricing is also beneficial to internationally operating companies. A company may actively influence its worldwide/consolidated tax rate by following the various transfer pricing regulations. Double tax agreements, especially those related to profit allocation, are especially relevant in this respect.
  8. Tax Services For Nonprofit Organizations – Tax advice is particularly crucial for tax-advantaged nonprofit organizations in Germany. They must keep abreast of numerous special tax regulations at all times. Nonprofit organizations are taxed in principle but are sometimes granted reduced tax rates. However, if a nonprofit organization’s economic income and sales remain within limits set by the German tax authorities, no taxes are due. Foreign charities recognized in Germany may enjoy tax-free income from German sources, even if they do not have a physical presence in Germany.

The Common Ways You Can Defend Yourself Against DUI Charges

DUI-Charges--

More and more states are adopting stricter DUI laws. Law enforcers and prosecutors want you to believe that you are automatically guilty if you are accused of driving under the influence. This is not always the case. You have rights, and there are ways to defend yourself against these charges. If you are charged with a DUI, it is crucial to understand the different ways you can defend yourself against the charges.

Here are some of the common ways you can defend yourself against DUI charges:

1. Lack of Probable Cause to Stop or Arrest for DUI

One of the most common ways to defend against DUI charges is to argue that the law enforcer did not have probable cause to sojourn your vehicle or arrest you for DUI. Probable cause is a rational belief that misconduct has been committed or is about to be achieved. This means that the police officer must have had a valid reason to believe that you were driving under the influence of alcohol or drugs to pull you over or arrest you for DUI.

If the police officer who pulled you over did not have a valid reason to do so, then any evidence obtained from the stop may be suppressed. This includes evidence such as your BAC results from a breathalyzer test or field sobriety test. Without this evidence, the prosecution may not be able to prove that you were driving under the influence, and the charges against you may be dropped.

2. Inaccurate Breathalyzer Test

Another common way to defend against DUI charges is to challenge the accuracy of the breathalyzer test. The result of a breathalyzer test is characteristically used as evidence to show that your BAC was over the legal limit. However, many factors can affect the accuracy of a breathalyzer test.

When charged with a DUI case, your lawyer can challenge the accuracy of the test by looking at factors such as the calibration of the machine, whether you had anything in your mouth that could have affected the test, and whether the officer who administered the test followed proper procedure. For example, if the breathalyzer machine was not correctly calibrated, the results of the test may be inexact.

3. Failing to Demonstrate Impairment of Faculties

The government will have to demonstrate that you were impaired by alcohol or drugs to the extent that your faculties to drive were diminished. This means that the prosecution will need to show that you were unable to safely operate a vehicle or that your ability to do so was significantly impaired.

The lack of roadside sobriety tests or other evidence of impairment can be used to defend against DUI charges. The challenge in proving this defense is that there is no specific BAC level at which everyone becomes impaired. However, the upright, divided attention and complex coordination necessary to drive safely generally become more difficult as BAC increases.

Overall, law enforcement officers and prosecutors must prove that the content of alcohol in your blood was way over the legal limit and that this actually impacted your ability to drive. If this cannot be shown, then you have a chance to dismiss your DUI charges and avoid a conviction.

How to Handle a School Bus Accident Claim

School-Bus

If you’ve been injured in a school bus accident, you may wonder what the process is for filing a claim against the driver or the school district. A personal injury claim can be complicated and requires navigating the red tape of insurance companies and legal teams. You may also need to provide medical documentation of your injuries, which can be time-consuming and expensive. Here’s how to file a claim following a school bus accident:

1. Determine if you are eligible for compensation

As a parent, if your child was injured in an accident on their way to or from school, then you may be eligible for compensation under different laws. The statute of limitations for filing a claim is two years from when the accident happened. If your child was injured more than two years ago, then it may not be possible to file a claim unless there are extenuating circumstances that would allow more time (for example, if they were only recently diagnosed with an injury).

2. Contact your insurance company

Your insurer will help you determine who was at fault and what steps must be taken next. Your insurance company should contact the other driver’s insurance company immediately after an accident to get estimates for repairs and medical bills before making any payments from either side. They will also investigate who was at fault and whether they were driving while intoxicated or distracted while operating. The sooner you contact them, the better they’ll be able to help, especially if any injuries are involved or the police need to be called out.

3. Call the police

Call the police if anyone is injured or if there may be any damage to property (i.e., lights or signs). Police should always be called out for accidents involving school buses because they carry children or special needs passengers who may require medical attention after an accident occurs on their bus. They also need to file reports to determine liability in case someone gets hurt by another driver’s negligence.

4. Contact an attorney

If you’re injured and have suffered significant losses, such as lost income from missed work or medical bills that your health insurance won’t cover, it may make sense to hire an attorney to help you compensate for those losses. The same goes for school bus accidents too.

As a parent, if your child has been injured in an accident, get help from a bus accident lawyer as soon as possible. Insurance companies will make lowball offers to encourage people to take quick settlements. A lawyer can help determine how much you should receive and will fight for the maximum compensation on your behalf.

5. Know how many people were on the bus

Take note of how many people were in your vehicle when the crash. If children are involved, ensure they are all accounted for and safe. It’s also important to note if anyone was injured in the crash and if there was any damage to your vehicle.

6. Get contact information from witnesses who saw what happened

Ask witnesses to write down their name, address, and phone number so they can be contacted later if needed by police or insurance investigators. Get names and contact information from any other drivers involved in the crash with insurance coverage that may cover your losses, such as liability or uninsured motorist coverage on their auto policy.

7. Take photos of visible damage

Take photos of any visible damage to your vehicle and any other vehicles involved in the collision — including school buses — and photos of any skid marks or debris from broken lights or signs on either vehicle that might help with reconstruction later on. Write everything about what happened before, during, and after the crash.
