Why do divorce settlements become disputed?

In many cases, two divorcing partners do not see eye to eye when considering how they are going to decouple and move on with their lives in separate directions.

This should not be surprising. After living together for years, the thought of separation is often upsetting. 

It can be a huge challenge to manage the emotions and to think straight enough to consider practical aspects of the future, such as:

  • Who will get custody of the children?
  • What will the visitation arrangements be for the non-custodial parent?
  • How much child support should be paid?
  • How will the marital property be divided?
  • Who gets the marital home?
  • Should spousal support be paid?

These issues are all ripe breeding grounds for conflict between a divorcing couple. 

Sometimes, they can be decided between the couple. However, in most cases, professional assistance is required.

That is when the lawyers or mediators may be called in.

 

What is divorce mediation?

Divorce mediation is the process by which a mediator is appointed by a divorcing couple in an attempt to resolve disputes and reach a settlement that can be passed through the courts.

The mediator must be an independent third-party that both spouses agree to appoint in an effort to reach a settlement out of court.

For divorce mediation to work, there must be a commitment from both parties to work towards a resolution and it is the mediator’s role to facilitate this.

The mediator will identify where the points of dispute are (these are usually the types of issues already outlined above) and then try to negotiate a mutually acceptable settlement.

It is important to note that the mediator does not make any decisions. He or she is not required to make a judgment and it is up to the two spouses to decide. 

If you are looking for a third-party to actually make a ruling, you need an arbitration process or litigation (discussed below).

All the mediator will do is try to lead the opposing sides to a satisfactory conclusion.

The mediator can be an attorney, retired judge, financial professional, or any other professional trained in mediation skills.

The main benefit of mediation is that it can keep matters out of court.

A contested divorce can be a messy affair that drags on for many months (even years in some cases) and is generally an expensive, time-consuming, and stressful ordeal for both parties.

Mediation can help you avoid much of that.

 

When do divorces result in litigation? 

When divorcing spouses are unable to resolve their disputes despite their best efforts and the best efforts of mediators (and sometimes even arbitrators) they usually hire lawyers and begin the litigation process.

Each spouse will appoint a lawyer to advocate for them and to look after their best interests during divorce proceedings.

While the legal steps vary from state to state and county to county, the opposing lawyers will generally negotiate to try to resolve the outstanding issues first. 

Failure to reach an agreement will leave only one option remaining: to take it through the local family court system.

Once the court date is finalized, the lawyers (with the aid of their clients) will prepare the documentary evidence to present to the judge presiding over the divorce proceedings. 

There may be witnesses, financial and medical professionals called, and even children asked to give evidence.

The family court judge will then decide on the key issues, such as child custody, parenting, child support payments, marital asset division, and spousal support.

This all means that you have little control over the process. Other people advocate for you and other people decide on the settlement – and the decision will be a matter of public record.

 

The main benefit of divorce litigation

Divorce litigation can get you the settlement you want and feel you deserve – even if your ex-spouse and his or her advisors do not agree with it.

The judge in divorce cases is committed to making a fair judgement, especially when it comes to looking after the interests of the children from the marriage.

If it is impossible to achieve that without litigation, it might be your best option.

 

Should you opt for mediation or litigation? 

Mediation and litigation are very different processes and their suitability for your situation will depend on several important factors in your relationship with your spouse.

In most cases, providing there is an element of goodwill remaining and a commitment to “work things out”, mediation is preferable to litigation.

If the possibility of an amicable agreement exists, mediation will mean that you remain in control of decision-making, reduce costs, keep the stress levels manageable, and keep decisions private. 

You will also avoid lengthy delays. A mediated divorce can be wrapped up in 2-6 months while a litigated divorce will be more like 18-36 months.

Plus, there is no “winner” and “loser”. This means that you have more chance of remaining on good terms with your ex-spouse and the extended family, which is far better for the children.

If, however, negotiations break down, the other party is unwilling to negotiate or is suspected of hiding assets or domestic abuse, litigation may be the only way.

Europe Pays the Highest Alcohol Tax Against the Rest of the World

Tax is a fact of life. Whether you’re a business accountant who encounters tax through daily use of online accounting software, or a customer making a single purchase in a shop, tax is an integral part of our economy that everyone is aware of.

Alcohol tax is occasionally increased to combat crime and deaths caused by excessive drinking around the world — Australia’s alcohol tax climbed 2.5% already this year and has been doing so every year for the last 35 years. The country also has restrictions on the service of alcohol and any person or company serving alcohol must complete a RSA course, or Responsible Service of Alcohol, to help reduce alcohol related incidents. According to research, alcohol tax cuts in England in 2012 resulted in roughly 2,000 deaths and around 100,000 extra crimes.

Tax can depend on the alcohol content in beer, wine, and spirits. For example, there’ll be a 12 cent increase on beer in South Africa, which will rise to R1.74 excise duty, a 750ml bottle of wine will rise 22 cents to R3.15, and a bottle of whiskey will go up by R4.54 to R65.84.

 

Countries with the highest alcohol tax

The average tax on alcohol is at 16% — both Zambia and Kenya have the average alcohol tax rate, with relatively low alcohol-related deaths at 2.1% and 2.6%, respectively, suggesting that alcohol tax is effective in these countries for reducing alcohol intake.

Interestingly, the top 16 countries that pay the highest tax are all European countries. Hungary is the highest at 27%, followed closely by Croatia, Denmark, Norway, and Sweden at 25%. But despite the higher alcohol tax rate, Hungary also had the second highest alcohol-related death rate at 6.7%, which in 2014 was reported as twice the global average. Norway’s alcohol mortality rate is 2%, with Sweden at 3.3%, Demark at 4.8%, and Croatia at 5.6%. Considering Andorra’s alcohol tax is one of the lowest at 4.5%, their mortality rate of 3.9% is considerably high when taking other countries into account.

 

Is higher alcohol tax effective?

Attempting to reduce alcohol consumption with a policy might not be as effective in all countries, with cultural differences playing a major part in drinking alcohol. For example, Hungary has been recognised by the WHO as a country that has adopted drinking alcohol as a large part of their culture, a trend common among Eastern European countries which is less prevalent in Scandinavian countries, reflecting findings of the data above — does this suggest that high tax works as a deterrent only if drinking alcohol isn’t a large part of the country’s culture?


Other countries that matched the average alcohol tax of 16% were Jordan and Mexico. Jordan’s alcohol mortality rate was the lowest at 0.4%, surprisingly followed by Mexico at the highest with 6.8%.

 

Alcohol tax and alcohol-related mortalities

Alcohol has been reported as being at the centre of daily and ritual life in numerous Mexican communities while simultaneously being a damaging factor both physically and socioeconomically. With a similar tax rate to Mexico of 15%, South Africa’s rate of alcohol-related deaths stands at 6.4%, one of the highest out of the countries selected for discussion. South Africa has some of the heaviest drinkers in the world — 61% of the population abstain from drinking, with around 31% drinking so heavily that it contributes to many societal and health problems. This suggests that perhaps alcohol tax isn’t effective in controlling alcohol death rates when drinking is so prevalent.

Similarly, Jordan had the same tax rate as Mexico, however their alcohol death rate stood at 0.4%. As 90% of the Jordanian population are Muslim, there’re stricter laws for drinking and being drunk in public. It would seem that religious belief can play a key part in societal expectations and regulations.

According to WHO, higher-income countries are more likely to introduce alcohol interventions — nearly all countries (95%) have implemented alcohol taxes, however less than half of these countries are also using further price strategies to reduce alcohol consumption by banning below-cost selling and bulk discounts. Many have television bans, but this is less common for digital marketing and social media.

Based on research, it would appear that increasing alcohol tax to reduce drinking largely depends on the extent to which drinking is a part of culture, as well as further government interventions and price strategies. Countries such as Hungary, Mexico, and South Africa where drinking is a popular activity will have less effective alcohol taxes in comparison to countries like Norway, Sweden, and Jordan where it isn’t indulged in as often.

Period Poverty in 2020 – Why Does it Still Exist?

According to Plan International UK, a dedicated children’s charity, one in every ten teenage girls will have experienced the problem of not being able to afford sanitary products. This issue has been picked up by many campaigners who are pushing to eradicate the financial barriers between girls and menstruation.

For young girls, thinking about first period symptoms can be extremely daunting as many may have to tackle the issues that are now grouped together as ‘period poverty’ — from a lack in menstrual education, to not being able to afford sanitary products and sacrificing days of education as a result.

This year it is time to address the issue of period poverty, focusing on how teenage girls are actively raising awareness of the topic. So, let’s talk about exactly why young girls need to be growing up in a world free of period poverty.

 

What exactly is Period Poverty?

A couple of retailers have swallowed the tax and a Tampon Tax Fund has been set up to support certain women’s charities, but that hasn’t changed the fact that many girls are growing up in a climate where they can’t afford these essential items.

But what is tampon tax? Well, it refers to the profits from the VAT charge of 5% applied to sanitary products and while this might be significantly less than the standard 20% VAT which applies to a whole host of other products, there is still dispute over whether we should be paying tax duties on these products at all.

This ties in with period poverty and the inability to afford sanitary products such as tampons, but it can also relate to a lack of understanding of menstruation. Governments have come under fire for matters such as the tampon tax, which is thought to contribute to period poverty.

 

What affect does Period Poverty have on Young Women?

On average, girls get the signs of their first period at around twelve years old, but periods can start for girls as young as eight. Not all young girls are fortunate enough to be able to add sanitary products onto their parents’ weekly shop and this has left many without access to sanitary items.

Spotting the signs of your first period and not being prepared to manage it can lead to a lot of stress, causing girls to feel anxious about their bodies. Experiencing symptoms and having no access to period products means that many girls could be going through period poverty during the peak years of their education and development.

The average schoolgirl is found to take three days off each term due to period related issues and 1,000 girls said that period poverty affected their academic performance. There needs to be a solution to remedy this, allowing girls to focus on their education.

 

How Are Authorities Addressing Period Poverty?

In April 2019, the UK Government’s Department for Education announced its commitment to providing free sanitary products across England’s primary schools by early 2020. The Children and Families Minister Zadhim Zahawi covered some of the key concerns for period poverty campaigners, outlining the move as a step towards enabling girls to meet their full potential, while also leading happy, healthy lives. The classroom is one of the key places to tackle period poverty and in February the UK government announced that it intends to implement classes on menstrual health by 2020, which is certainly a step in the right direction when it comes to educating young girls about their periods.

 

Period Poverty In The Classroom

There’s certainly a stigma around menstruation and by leveling the playing field early on, we can inform young girls about what to expect from their first period and that it is totally natural. Plan International UK found that some of the most reoccurring reasons cited by girls missing school lessons, due to period related issues, were embarrassment and anxiety about the situation. This demonstrates the need for period education and schools should be striving to tackle this and make classrooms a safe space for all youngsters.

There’s often a lot of pressure placed on parents to teach their daughters about periods but if they don’t know, they can’t share so we should be more proactive in talking about menstruation in the classroom. As we’ve already mentioned, the government is taking the right steps towards bringing periods into the classroom and by educating girls at a young age, the school system can help to tackle period poverty at its very origin.

As women, we have a duty to share and support each other through an experience that we all have in common, so let’s tackle period poverty and raise a generation of girls who have ready access to essential sanitary products and are empowered by their bodies, not held back by them.

Thanks to various widespread social media movements, there is already a growing understanding of period poverty amongst teenagers and young girls. PHS Group carried out a survey in which a third of participants said that either they or someone they knew had been affected by period poverty. Teen activist Amika George began the #FreePeriods movement, and the nineteen-year-old is amplifying the message that no young girl should have to miss out on learning because they can’t afford sanitary products. She has joined forces with various other campaigns such as the Pink Protest and the Red Box Project to reiterate the importance of achieving period equality for all girls.
